Yes, a registration in the External Reference Register (EVR) is not always permanent. If the registration is disproportionate, the facts are incorrect, or the bank’s interest no longer outweighs yours, removal can be enforced through legal proceedings.
Not necessarily. Under the WHOA legislation (the Dutch Scheme), we can attempt to restructure your company. We offer creditors a composition that can be imposed by the court, often preventing bankruptcy altogether.
Injunctive proceedings (kort geding) are designed for matters involving an ‘urgent interest’. Think of a threatened eviction, an unlawful attachment of assets, or a breach of contract that directly endangers the continuity of your business. Speed is critical.
